Call for papers: International Conference on Maritime Actors and Climate Change – Incentives and Strategies for Voluntary Action
The Center for Enterprise Liability (CEVIA), Faculty of Law, University of Copenhagen and the Frank Guarini Center, School of Law, New York University welcome proposals for papers/presentations at the International Conference on Maritime Actors and Climate Change, which will take place in Copenhagen, Denmark, on the 20th and 21st of June 2016. The conference is open to scholars from law and other social sciences with a research interest in maritime transport and climate change. ICJ: Nicaragua v. Colombia judgment on preliminary objections delivered
The International Court of Justice delivered its Judgment on the preliminary objections raised by Colombia in the case concerning Question of the Delimitation of the Continental Shelf between Nicaragua and Colombia beyond 200 nautical miles from the Nicaraguan Coast (Nicaragua v. Colombia). The Court found that it has jurisdiction, on the basis of Article XXXI of the Pact of Bogotá, to entertain the First Request put forward by Nicaragua in its Application, in which it requests the Court to determine the precise course of the maritime boundary between Nicaragua and Colombia in the areas of the continental shelf which appertain to each of them beyond the boundaries determined by the Court in its Judgment of 19 November 2012, and that that Request is admissible. Conference: International Law and Japanese Approaches – The Law of the Sea and International Peace Operations
On 26 February 2016, the T.M.C. Asser Instituut will organise a Symposium on International Law and Japanese Approaches. The panel sessions will be devoted to two topics: the disputes in the maritime areas of East Asia; and the changing role of the Japan Self-Defense Forces in international peace operations. Call for papers: Innovating for change in global fisheries governance
The K. G. Jebsen Centre for the Law of the Sea of the Arctic University of Norway in Tromsø just announced a symposium entitled ‘Innovating for Change in Global Fisheries Governance’. The symposium aims to address the following question: How can international law be used as an innovative mechanism for change in global fisheries governance? Taiwan, Philippines sign fisheries law enforcement agreement
After several rounds of negotiations in the past two years, Taiwan and the Philippines concluded the Agreement Concerning the Facilitation of Cooperation on Law Enforcement in Fisheries Matters on November 5, 2015. The agreement contains seven articles and includes three important points of consensus that have already been implemented—avoiding the use of violence or unnecessary force, establishment of an emergency notification system, and establishment of a prompt release mechanism. PCA: the “Enrica Lexie” Incident (Italy v. India)
Months after the ITLOS Order on the “Enrica Lexie” Incident has been delivered (see post), the Permanent Court of Arbitration just announced that the constitution of the Arbitral Tribunal in an arbitration between the Italian Republic and the Republic of India under Annex VII to the UNCLOS has been completed. Palau: National Marine Sanctuary Act signed
The western Pacific archipelago of Palau has approved the creation of a marine sanctuary. The sanctuary becomes the world’s sixth-largest fully protected area. This means that 80% of the nation’s maritime territory is now designated as a reserve. The bill to create it was passed unanimously, 16-0 in the house of delegates, and the senate voted to adopt it. IMO: Revised guidance on radioactive waste adopted
Updated guidelines for the application of the de minimis (exempt) concept for radioactive substances which may be considered for dumping at sea have been adopted. The 2015 Guidelines for the application of the de minimis concept include recognition of effects of radiation on marine fauna and flora. They were adopted by the 37th Consultative Meeting of Contracting Parties (London Convention 1972) and 10th Meeting of Contracting Parties (London Protocol 1996), which were meeting for their regular joint meeting at IMO in London. Tokyo MOU: Peru and Panama join
The secretariat of the Tokyo Memorandum of Understanding on Port State Control has announced that, following an acceptation procedure, the Republic of Panama and the Republic of Peru have been accepted as full members of the organization. More information on this can be found here.

UNSC: Resolution 2240 (2015)
The United Nations Security Council adopted on 9 October a resolution authorizing states to exercise exceptional powers with respect to ships suspected of being engaged in human trafficking and migrant smuggling on the high seas off the costs of Libya. The resolution can be found here.

The Centre for International Law (CIL) at the National University of Singapore (NUS) and the K.G. Jebsen Centre for the Law of the Sea (JCLOS) at the University of Tromsø are hosting in Singapore a Conference on the Governance of Arctic Shipping. World Maritime Day 2015
Today is the World Maritime Day 2015, dedicated to the theme “Maritime education and training”.
As we can learn from the UN website, the theme was adopted to focus attention on the wider spectrum of maritime education and training, in particular its adequacy and quality, as the bedrock of a safe and secure shipping industry, which needs to preserve the quality, practical skills and competence of qualified human resources, in order to ensure its sustainability.
The IMO is holding a symposium on “Shipping’s future needs people: Is global maritime education and training on course?” Speakers from the shipping and maritime industry and academia will address three sessions, covering (1) Opportunities for the young generation in the maritime industry (2) Seafaring as a profession and (3) Developing seafarer skills through quality maritime education and training. Black Sea MOU: New Inspection Regime from 2016
At the 16th meeting of the Port State Control Committee in Batumi, Georgia, April 2015, the Memorandum of Understanding on Port State Control in the Black Sea Region decided to introduce a New Inspection Regime for selection of ships from 1st January 2016 to harmonize further its risk based targeting and inspection system with the leading memorandas, namely Paris MOU and Tokyo MOU, to the highest level. The Centre of Excellence Operations In Confined and Shallow Waters is organizing its 3rd Conference on Operational Maritime Law. The event is to occur in Lisbon, Portugal, at the Instituto de Estudos Superiores Militares, between the 21 and 24 of September. Conference: Future-Ready Shipping 2015
An International Conference on Maritime Technology Transfer and Capacity-Building is to occur in Singapore on 28 to 29 September 2015. ITLOS: the “Enrica Lexie” Incident (Italy v. India) Order delivered
The International Tribunal for the Law of the Sea delivered its Order in The “Enrica Lexie” Incident (Italy v. India), Provisional Measures case. The operative provisions prescribe, pending a decision by the Annex VII arbitral tribunal, the following provisional measures under article 290, paragraph 5, of the Convention:
Italy and India shall both suspend all court proceedings and shall refrain from initiating new ones which might aggravate or extend the dispute submitted to the Annex VII arbitral tribunal or might jeopardize or prejudice the carrying out of any decision which the arbitral tribunal may render;
Italy and India shall each submit to the Tribunal the initial report referred to in paragraph 138 not later than 24 September 2015, and authorizes the President, after that date, to request such information from the Parties as he may consider appropriate;
Both prescriptions were adopted by a majority of 15 to 6. The full text of the Order can be found here.

ITLOS: the “Enrica Lexie” Incident (Italy v. India)
The International Tribunal for the Law of the Sea has been requested by Italy to prescribe provisional measures under article 290, paragraph 5, of the United Nations Convention on the Law of the Sea in a dispute with the Republic of India over the incident involving the MV Enrica Lexie, an oil tanker flying the Italian flag. By Order dated 24 July 2015, the President of the Tribunal, Judge Vladimir Golitsyn, fixed 10 August 2015 as the date for the opening of the public hearing in the case. PCA: The Republic of the Philippines v. The People’s Republic of China fourth procedural order issued

ITLOS: Ghana/Côte D’ivoire Order announced
The Special Chamber of the International Tribunal for the Law of the Sea, established to deal with the dispute concerning delimitation of the maritime boundary between Ghana and Côte d’Ivoire in the Atlantic Ocean will deliver its Order in the provisional measures phase of the case on Saturday, 25 April 2015. Judge Boualem Bouguetaia, President of the Special Chamber, will read the Order at a public sitting which will be held at 3 p.m. More information available in the ITLOS press release.

The International Maritime Organization (IMO), World Maritime University (WMU) and the Protection of the Arctic Marine Environment (PAME) working group of the Arctic Council have announced a call for papers for a joint International Conference on Safe and Sustainable Shipping in a Changing Arctic Environment (ShipArc 2015), to be held from 25 to 27 August 2015 at WMU in Malmö, Sweden. Conference: Interspill Amsterdam 2015
The Interspill Conference is happening in Amsterdam this year, between 24 and 26 March. It will be held at Amsterdam RAI Convention Centre, the Netherlands, and is co-organised by Reed Exhibitions and Interspill Ltd. Call for Papers: Brazilian Journal of International Law
The first 2015 edition of the Brazilian Journal of International Law (Revista de Direito Internacional) will be devoted to the Law of the Sea and Maritime Law. Call for Papers: Environmental Standards for Deep Seabed Mining
The K.G. Jepsen Centre for the Law of the Sea at the Arctic University of Tromsø is hosting a workshop on Environmental Standards for Deep Seabed Mining in Tromsø, Norway on 6‐8 May 2015. In addition to two keynote speeches on invitation by the organizers the workshop calls for abstracts by researchers (including young scientists) with a background in law, political sciences or environmental economics. On the basis of the submitted abstracts the steering committee will invite six speakers to present their papers at the workshop. PCA: The Republic of the Philippines v. The People’s Republic of China (update)
Despite the Note Verbale sent to the PCA on 1 August 2013, in which it reiterated “its position that it does not accept the arbitration initiated by the Philippines”, China has now reacted to the initiation of arbitration procedures through an official statement published in the Government’s website. You can have access to the whole document here: Position Paper of the Government of the People’s Republic of China on the Matter of Jurisdiction in the South China Sea Arbitration Initiated by the Republic of the Philippines. The deadline for an official reply from PRC to the arbitration court is the 15 December 2014.

PCA: Arctic Sunrise Arbitration (Netherlands v. Russia)
On 4 October 2013, the Kingdom of the Netherlands instituted arbitral proceedings against the Russian Federation under Annex VII to the United Nations Convention on the Law of the Sea. The dispute concerns the boarding and detention of the vessel Arctic Sunrise in the exclusive economic zone of the Russian Federation and the detention of the persons on board the vessel by the Russian authorities. By Note Verbale to the PCA dated 27 February 2014, the Russian Federation has indicated its “refusal to take part in this arbitration”.
