Conference: Knowing the Oceans for Achieving Sustainable Development

The Institut du Droit Économique de la Mer (INDEMER) is organizing an international conference entitled “Knowing the Oceans for Achieving Sustainable Development”. UN: Oceans Action Hub discussion “About Implementing International Law as reflected in UNCLOS”

As previously reported, the United Nations (UN) is hosting the Oceans Conference in June this year, to support the implementation of Sustainable Development Goal 14. In preparation for that meeting, the UN Oceans Action Hub is hosting a set of open online discussions. The current one is about the implementation of international law as reflected in the United Nations Convention on the Law of the Sea. This online debate is open to contributions between 3 – 21 April 2017 and can be joined here.

New Zealand: Fiordland marine protection plan approved

The Fiordland Marine Regional Pathway Management Plan is the first of its kind in New Zealand. The Plan aims to greatly reduce the risk of marine pests being carried in on local and visiting vessels. The plan sets out a number of rules and standards that must be met by all vessels entering within one nautical mile of the landward boundary of the Fiordland Marine Area and requires vessel operators to obtain a Fiordland Clean Vessel Pass. ITLOS: 2017/2018 Capacity-Building and Training Programme

The International Tribunal for the Law of the Sea has launched the 2017-2018 edition of its capacity-building and training programme on dispute settlement under the United Nations Convention on the Law of the Sea. This initiative was established in 2007 with the financial support of the Nippon Foundation and each edition consists on a full-time nine-month programme. Targeted participants are young government officials or researchers currently working on issues of the law of the sea or dispute settlement who are looking to develop their legal skills and deepen their practical knowledge of the settlement of disputes mechanisms. Conference: High Seas Governance: Gaps and Challenges

The Centre for International Law (National University of Singapore) is hosting a conference entitled “High Seas Governance: Gaps and Challenges”. This event will explore some of the gaps in the governance of the high seas in UNCLOS. It will examine the relationship between UNCLOS and other existing international instruments and mechanisms that protect the sensitive marine environment, and also explore trends in environmental policy and governance. Side event: possible implications of a BBNJ Agreement for Arctic marine governance

The JCLOS and FNI will host a side event on the “possible implications of a BBNJ (biodiversity beyond national jurisdiction) Agreement for Arctic marine governance”. The side event is part of the upcoming negotiating session towards a new treaty on marine biodiversity at the United Nations in New York. The side event will be held on 5 April 2017, 13.15-14.30, in Conference Room 11 at UN Headquarters. More information here.

The Centre for East Asian Studies in Groningen, the Netherlands, is organizing a workshop entitled “Navigating the South China Sea: Challenges and Opportunities”. Workshop: Towards an ISA Environmental Management Strategy for the Area

A workshop on the International Seabed Authority (ISA) Environmental Management Strategy for the Area will be held in Berlin, Germany from 19-24 March 2017. The workshop aims to assist the Authority in developing a long-term Environmental Management Strategy for the Area. It will deal with governance issues such as overarching principles, regional planning and adaptive management. The outcome of the workshop should provide a first structured and interdisciplinary input on the draft Environmental Regulations taking into account the deliberations by the Legal and Technical Committee in February 2017. Conference: Pushing the Limits of UNCLOS

The 9th edition of the ABLOS conference, organized by the Advisory Board on the Law of the Sea, will address advances and challenges in governing our shared Blue World under the framework of the UN Convention on the Law of the Sea from both legal and technical perspectives. Themes to be discussed include: implications of new and developing technologies on the law of the sea, progress towards safeguarding biodiversity in Areas Beyond National Jurisdiction (ABNJ), deep seabed mining, legal and technical aspects of defining insular features and the application of UNCLOS in high latitudes. The event is set to happen on 10 – 11 October, 2017 at the International Hydrographic Bureau in Monaco. Abstracts are accepted until 1st June 2017. More information available here and here.

NGO: Voluntary Code of Conduct for Search and Rescue Operations

The NGO Human Rights at Sea just published its “Voluntary Code of Conduct for Search and Rescue Operations undertaken by civil society Non-Governmental Organisations in the Mediterranean Sea”. This document is presented as the first voluntary minimum standard guidance working towards increased levels of joint co-ordination and co-operation for the on-going humanitarian relief effort in the Mediterranean region. The first edition of the document is intended to act as the basis for rapid iterative development with as many stakeholders as possible, including European Institutions, Agencies, shipping and fishing associations and military forces. Marshall Islands: Low Sulfur Fuel Oil Testing Guidance

The Republic of the Marshall Islands has issued a Marine Safety Advisory, which provides guidance on the testing of Low Sulfur Marine Gas Oil fuel oil by port States in order to ensure ships are using fuel with no more than 0.10 percent sulfur content for MARPOL compliance. The advisory highlights the International Maritime Organization Circular MEPC.1/Circ.864 (Guidelines For Onboard Sampling For The Verification Of The Sulphur Content Of The Fuel Oil Used On Board Ships), issued in December. It also advises that plans should designate a ship’s representative responsible for retaining and securing the spot sampling container in accordance with Article 6 of EU Decision 2015/253. EU: new regulation on fleet register

The Fleet Register is a database where all the fishing vessels flying the flag of a European Union (EU) member state have to be registered in accordance with Community legislation. Updates to the EU’s fleet register will soon be available in real time, following the adoption of a new regulation by the European Commission. The regulation makes it easier for EU member states to update the fleet register, while giving the Commission the necessary tools to crosscheck the data that member states submit. The new regulation enters into force on 1 February 2018, and applies to all commercial fishing vessels, except aquaculture vessels and blue fin tuna traps. More information available here.

ICJ: Somalia v. Kenya Judgement on preliminary objections delivered

Following our previous post, the International Court of Justice (ICJ) has delivered today its Judgment on the preliminary objections raised by Kenya in the case concerning Maritime Delimitation in the Indian Ocean (Somalia v. Kenya). It finds that it may proceed with the maritime delimitation between Somalia and Kenya in the Indian Ocean. The Judgement can be found here and the summary here.

The Twentieth International Congress of Maritime Arbitrators (ICMA XX) will take place in Copenhagen, Denmark from 25 to 29 September 2017. Papers on any subject matter relevant to the practice of maritime law and maritime arbitration of both a procedural and substantive nature are invited. The Frankfurt Investment Law Workshop 2017 will address the topic “Oceans and Space: New Frontiers in Investment Protection?”. The University of Utrecht in the Netherlands is organizing a summer school entitled “Introduction to the International Law of the Sea”. This will occur between 10 July 2017 – 14 July 2017 (5 days) and the target audience includes (post)graduate students, academics, professionals working in law of the sea-related sectors, and others interested in the regulation of the use of our oceans. DCOC: adoption of the Jeddah Amendment

A high-level meeting of signatories to the Djibouti Code of Conduct (DCOC), held in Jeddah, Saudi Arabia, has adopted a revised Code of Conduct, which will be known as the “Jeddah Amendment to the Djibouti Code of Conduct 2017”. The revised code of conduct builds on the earlier Code, which was adopted under the auspices of IMO in 2009. The Jeddah Amendment calls on the signatory States to cooperate to the fullest possible extent to repress transnational organized crime in the maritime domain, maritime terrorism, illegal, unregulated and unreported fishing and other illegal activities at sea. UNGA: World Tuna Day proclaimed

The UN General Assembly proclaimed the 2 May as the “World Tuna Day”, spotlighting the vital socioeconomic importance of the widely consumed fish to peoples around the globe. The Assembly then adopted another resolution by consensus, titled “Sustainable fisheries, including through the 1995 Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks, and related instruments” (document A/71/L.24). Conference: European Shipping Week

The European Shipping Week will take place in Brussels from 27 February to 3 March 2017. This event is intended to be a platform where policy-makers from the main EU institutions will meet and engage with European shipowners and other stakeholders from the shipping sector. It is an initiative of the European Community Shipowners’ Associations and is run by a Steering Group made up of Europe’s main shipping organizations as well as the European Commission and Shipping Innovation. Conference: Symposium on the South China Sea Award

The Netherlands Institute for the Law of the Sea (NILOS) and the Utrecht Centre for Water Ocean and Sustainability Law (UCWOSL) organize a symposium discussing the pertinent legal issues arising from the PCA Award on The South China Sea Arbitration (The Republic of Philippines v. IOC: 2nd International Conference on Marine Spatial Planning

The Intergovernmental Oceanographic Commission (IOC) of the United Nations Educational, Scientific, and Cultural Organization (UNESCO) will hold its second international conference on Marine Spatial Planning (MSP) at UNESCO headquarters in Paris (France) from 15-17 March 2017. ITLOS: Tribunal has jurisdiction over The M/V “Norstar” Case (Panama v. Italy)

The Judgment of the Tribunal on the Preliminary Objections raised by Italy on 11 March 2016 in The M/V “Norstar” Case (Panama v. Italy) was delivered today. The Tribunal finds that it has jurisdiction to adjudicate the dispute and decides that Panama’s application is admissible. According to the Application, the dispute concerns the arrest and detention of the M/V “Norstar”, a Panamanian-flagged oil tanker. More details can be found in the Tribunal’s Judgement.

CCAMLR: agreement on Antarctica’s Ross Sea Marine Protected Area

All member states of the Commission for the Conservation of Antarctic Marine Living Resources (CCAMLR) have agreed to a joint USA/New Zealand proposal to establish a 1.55 million km2 area of the Ross Sea with special protection from human activities. This new MPA, to come into force in December 2017, will limit, or entirely prohibit, certain activities in order to meet specific conservation, habitat protection, ecosystem monitoring and fisheries management objectives. World Maritime Day 2016 and Parallel Event

World Maritime Day has been celebrated at IMO Headquarters on 29 September 2016. The theme for this year’s edition was “Shipping: indispensable to the world”. This theme was chosen to focus on the critical link between shipping and global society and to raise awareness of the relevance of the role of IMO as the global regulatory body for international shipping. A Parallel Event will be held in Istanbul, Turkey, from 4 to 6 November 2016. It includes a conference, the program of which is already available here.

PCA: Conciliation between the Democratic Republic of Timor-Leste and the Commonwealth of Australia (update)

Following what has been previously reported here and here, the PCA’s Conciliation Commission has issued its Decision on Competence in the compulsory conciliation initiated between Timor-Leste and the Australia under Annex V of the United Nations Convention on the Law of the Sea. In its Decision, the Commission held that it was competent to continue with the conciliation process. These compulsory conciliation proceedings concern the maritime boundary between both States and were initiated by Timor-Leste by way of a Notice addressed to Australia pursuant to Article 298 and Annex V of the Convention. More information about this development can be found in the PCA’s press release.

Call for papers: MARENER 2017

The World Maritime University will be hosting an international conference on Maritime Energy Management (MARENER 2017). This event is expected to provide a forum for both researchers and practitioners to examine opportunities and challenges in the field of maritime energy with the aim of achieving an energy efficient and low carbon future for the maritime industry. The conference will occur in Malmö, Sweden, on 24-25 January 2017. Authors are invited to submit abstracts in English by 30 September 2016. ITLOS celebrating 20th anniversary

The International Tribunal for the Law of the Sea will be celebrating its 20th anniversary in October 2016. On this occasion, a one-and-a-half day international symposium will be held on 5 and 6 October 2016. One of the events is entitled “The contribution of the Tribunal to the Rule of Law” and its aim is to highlight the role played by the Tribunal over the last 20 years in the system for the peaceful settlement of law of the sea-related disputes set out in Part XV of the UNCLOS. The ceremony will occur at the Tribunal’s premises, as reported by the President of ITLOS here (paragraphs 33 and 34), followed the next day by a reception at the City Hall of Hamburg.

A maritime delimitation agreement has been reached between Colombia, Costa Rica and Ecuador. This agreement has been formally reached at the Galapagos islands of Ecuador. IMO: BWM Convention enters into force on 8 September 2017

The Ballast Water Management Convention was ratified by a sufficient number of states on 8 September 2016, bringing the total gross tonnage to over 35% from the signatory states. This means the convention will enter into force 12 months later, on 8 September 2017. Accession by Finland has triggered the entry into force of this key international measure for environmental protection that aims to stop the spread of potentially invasive aquatic species in ships’ ballast water. CLCS: Uruguay to extend continental shelf up to 350 nautical miles

The Commission on the Limits of the Continental Shelf has communicated its recommendation for the establishment of the outer limits of the Uruguayan continental shelf. According to a statement by the Ministry of Foreign Affairs of Uruguay, this recommendation implies “a territorial extension for Uruguay of approximately 83.000 sq km, encompassing all its continental margin and allowing to establish what has been called the country’s final frontier at 350 nautical miles”. PCA: The Duzgit Integrity Arbitration (Malta v. São Tomé and Príncipe) Award delivered

The Tribunal constituted under Annex VII to the United Nations Convention on the Law of the Sea (UNCLOS) in the matter of the Duzgit Integrity Arbitration has just issued an Award in respect of the dispute between the Republic of Malta and the Republic of São Tomé and Príncipe. The dispute concerns the arrest by São Tomé of a Maltese flagged vessel – the Duzgit Integrity – on 15 March 2013 when it attempted to undertake a ship-to-ship (“STS”) cargo transfer in São Tomé’s archipelagic waters, and the subsequent measures taken by São Tomé in relation to the vessel, its master, cargo, owner and charterer.

The Tribunal found that it had jurisdiction over the dispute and that, while the initial detention of the vessel fell within the lawful exercise by São Tomé of its law enforcement jurisdiction, the other penalties imposed by São Tomé could not be regarded as proportional to the original offence or the interest of ensuring respect for São Tomé’s sovereignty. Accordingly, the Tribunal held that the cumulative effect of the sanctions imposed by São Tomé was incompatible with Article 49 of the UNCLOS and that Malta was entitled to claim reparation in a further phase of the proceedings.

Conference: Obligations of States in Undelimited Maritime Areas

The British Institute of International and Comparative Law is holding in London, the UK, an event entitled “Obligations of States in Undelimited Maritime Areas”. This event will analyse and discuss the obligations of States in regard to undelimited areas pending agreement on maritime boundary delimitation. PCA: Philippines v. China (final Award)

The PCA has issued today a unanimous Award in the arbitration instituted by the Republic of the Philippines against the People’s Republic of China. This arbitration concerned the role of historic rights and the source of maritime entitlements in the South China Sea, the status of certain maritime features and the maritime entitlements they are capable of generating, and the lawfulness of certain actions by China that were alleged by the Philippines to violate the UNCLOS. IMO: SOLAS regulation on enclosed spaces enters into force

A new regulation aimed at protecting seafarers who need to enter enclosed spaces, by requiring ships to carry portable atmosphere testing equipment on board, entered into force on 1 July 2016. The new regulation XI-1/7 Atmosphere testing instrument for enclosed spaces in the International Convention for the Safety of Life at Sea (SOLAS), requires ships to carry an appropriate portable atmosphere testing instrument or instruments, capable, as a minimum, of measuring concentrations of oxygen, flammable gases or vapours, hydrogen sulphide and carbon monoxide, prior to entry into enclosed spaces. Conference: Piraeus International Conference of Maritime Law (9th)

The Piraeus Bar Association is organizing the 9th edition of its International Conference of Maritime Law. This event is the sequel of a tradition established 24 years ago. It will be held in Piraeus from 13 to 15 October 2016 and will deal with Maritime Safety and Security (legal implications to ships, cargo and the human element). PCA: Philippines v. China (date for issuance of final Award)

The Permanent Court of Arbitration has today informed the Parties that the Tribunal will issue its Award in the arbitration initiated by the Republic of the Philippines against the People’s Republic of China under Annex VII to the United Nations Convention on the Law of the Sea. IMO: MSC agrees on new bulk carrier rules

IMO’s Maritime Safety Committee (MSC) has confirmed that ship construction rules for oil tankers and bulk carriers submitted by 12 classification societies conform to the goals and functional requirements set by the Organization for new oil tankers and bulk carriers. This marks a significant new development in how international standards for ship construction are determined and implemented. For the first time, IMO has been given a role in auditing and verifying the structural rules developed by the classification societies for new-build oil tankers and bulk carriers. India) adopted its Order in respect of a request by Italy for the prescription of provisional measures. In the operative part of the Order, the Arbitral Tribunal unanimously prescribed the following provisional measures:

a) Italy and India shall cooperate, including in proceedings before the Supreme Court of India, to achieve a relaxation of the bail conditions of Sergeant Girone so as to give effect to the concept of considerations of humanity, so that Sergeant Girone, while remaining under the authority of the Supreme Court of India, may return to Italy during the present Annex VII arbitration.
b) The Arbitral Tribunal confirms Italy’s obligation to return Sergeant Girone to India in case the Arbitral Tribunal finds that India has jurisdiction over him in respect of the “Enrica Lexie” incident.
c) The Arbitral Tribunal decides that Italy and India each shall report to the Arbitral Tribunal on compliance with these provisional measures, and authorizes the President to seek information from the Parties if no such report is submitted within three months from the date of this Order and thereafter as he may consider appropriate.

Marshall Islands: maritime boundaries declared to UN

The Republic of the Marshall Islands has reached a major milestone in ocean resource management and international relations following the submission of their completed maritime boundary legislation to the United Nations on 22 April 2016. This legislation includes more than 450 pages of geographical coordinates, treaty agreements, and a total of 25 charts which will officially declare the baselines and the outer limits of all of its maritime zones under the national jurisdiction of the Marshall Islands. 6th conference in Maritime Spatial Planning Worldwide

The sixth conference of the MSP stakeholder series, focussing on MSP Worldwide will be organised on 8 and 9 June 2016 by DG MARE in University of the Azores, Ponte Delgada, Azores. The conference will present experiences, opportunities and challenges of MSP implementation around the world. In particular it will look at MSP’s economic benefits, its potential as a climate adaptation tool as well as at the role of area-based management regimes in international waters. The main purpose is to take stock of what is being done at international level and identify potential synergies with EU MSP. More information can be found here.

IMO: mandatory requirements on fuel consumption data approved

The Marine Environment Protection Committee (MEPC) of the International Maritime Organization (IMO) has approved mandatory requirements for ships to record and report their fuel consumption.The draft mandatory data collection requirements will be put forward for adoption at the 70th MEPC session in October this year and could enter into force in 2018. The data collection system is enshrined in draft amendments to the International Convention for the Prevention of Pollution from Ships (MARPOL), which were approved by the 69th session of the MEPC, meeting at IMO Headquarters in London this week (18 to 22 April). More information on the matter available here.
