The University of Utrecht in the Netherlands is organizing a summer school entitled “Introduction to the International Law of the Sea”. This will occur between 10 July 2017 – 14 July 2017 (5 days) and the target audience includes (post)graduate students, academics, professionals working in law of the sea-related sectors, and others interested in the regulation of the use of our oceans. DCOC: adoption of the Jeddah Amendment
A high-level meeting of signatories to the Djibouti Code of Conduct (DCOC), held in Jeddah, Saudi Arabia, has adopted a revised Code of Conduct, which will be known as the “Jeddah Amendment to the Djibouti Code of Conduct 2017”. The revised code of conduct builds on the earlier Code, which was adopted under the auspices of IMO in 2009. The Jeddah Amendment calls on the signatory States to cooperate to the fullest possible extent to repress transnational organized crime in the maritime domain, maritime terrorism, illegal, unregulated and unreported fishing and other illegal activities at sea. The 9th MARE People & the Sea Conference will take place in Amsterdam on 5-7 July 2017 under the topic “Dealing with Maritime Mobilities”. UNGA: World Tuna Day proclaimed
The UN General Assembly proclaimed the 2 May as the “World Tuna Day”, spotlighting the vital socioeconomic importance of the widely consumed fish to peoples around the globe. The Assembly then adopted another resolution by consensus, titled “Sustainable fisheries, including through the 1995 Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks, and related instruments” (document A/71/L.24). Conference: European Shipping Week
The European Shipping Week will take place in Brussels from 27 February to 3 March 2017. This event is intended to be a platform where policy-makers from the main EU institutions will meet and engage with European shipowners and other stakeholders from the shipping sector. It is an initiative of the European Community Shipowners’ Associations and is run by a Steering Group made up of Europe’s main shipping organizations as well as the European Commission and Shipping Innovation. ITLOS: Tribunal has jurisdiction over The M/V “Norstar” Case (Panama v. Italy)
The Judgment of the Tribunal on the Preliminary Objections raised by Italy on 11 March 2016 in The M/V “Norstar” Case (Panama v. Italy) was delivered today. The Tribunal finds that it has jurisdiction to adjudicate the dispute and decides that Panama’s application is admissible. According to the Application, the dispute concerns the arrest and detention of the M/V “Norstar”, a Panamanian-flagged oil tanker. More details can be found in the Tribunal’s Judgement.

Maritime Boundary Agreement signed (Vanuatu/Solomon Islands)
On the 7th October 2016 Vanuatu and the Solomon Islands concluded 33 years of negotiation by signing a maritime boundary agreement addressing “Temotu Province in Solomon Islands and Torba Province of Vanuatu”. The agreement was signed on Mota Lava Island, Vanuatu (see references ‘Mota Lava Treaty’).

CCAMLR: agreement on Antarctica’s Ross Sea Marine Protected Area
All member states of the Commission for the Conservation of Antarctic Marine Living Resources (CCAMLR) have agreed to a joint USA/New Zealand proposal to establish a 1.55 million km2 area of the Ross Sea with special protection from human activities. This new MPA, to come into force in December 2017, will limit, or entirely prohibit, certain activities in order to meet specific conservation, habitat protection, ecosystem monitoring and fisheries management objectives. World Maritime Day 2016 and Parallel Event
World Maritime Day has been celebrated at IMO Headquarters on 29 September 2016. The theme for this year’s edition was “Shipping: indispensable to the world”. This theme was chosen to focus on the critical link between shipping and global society and to raise awareness of the relevance of the role of IMO as the global regulatory body for international shipping. A Parallel Event will be held in Istanbul, Turkey, from 4 to 6 November 2016. It includes a conference, the program of which is already available here.

PCA: Conciliation between the Democratic Republic of Timor-Leste and the Commonwealth of Australia (update)
Following what has been previously reported here and here, the PCA’s Conciliation Commission has issued its Decision on Competence in the compulsory conciliation initiated between Timor-Leste and the Australia under Annex V of the United Nations Convention on the Law of the Sea. In its Decision, the Commission held that it was competent to continue with the conciliation process. These compulsory conciliation proceedings concern the maritime boundary between both States and were initiated by Timor-Leste by way of a Notice addressed to Australia pursuant to Article 298 and Annex V of the Convention. Our Ocean 2016: Initiatives
Following the previously reported 2014 and 2015 Our Ocean Conferences, the third Our Ocean Conference was held in Washington, DC (USA), 15-16 September, 2016. Over 136 new initiatives on marine conservation and protection were announced and the initiative is set to continue past the Obama Administration with the conferences in 2017 hosted by the European Union in Malta, in 2018 in Indonesia, and in 2019 in Norway.

Call for papers: MARENER 2017
The World Maritime University will be hosting an international conference on Maritime Energy Management (MARENER 2017). This event is expected to provide a forum for both researchers and practitioners to examine opportunities and challenges in the field of maritime energy with the aim of achieving an energy efficient and low carbon future for the maritime industry. The conference will occur in Malmö, Sweden, on 24-25 January 2017. Authors are invited to submit abstracts in English by 30 September 2016. ITLOS celebrating 20th anniversary
The International Tribunal for the Law of the Sea will be celebrating its 20th anniversary in October 2016. On this occasion, a one-and-a-half day international symposium will be held on 5 and 6 October 2016. One of the events is entitled “The contribution of the Tribunal to the Rule of Law” and its aim is to highlight the role played by the Tribunal over the last 20 years in the system for the peaceful settlement of law of the sea-related disputes set out in Part XV of the UNCLOS. The ceremony will occur at the Tribunal’s premises, as reported by the President of ITLOS here (paragraphs 33 and 34), followed the next day by a reception at the City Hall of Hamburg.

Ukraine Initiate Arbitration Against the Russian Federation under UNCLOS
According to the Ministry of Foreign Affairs of Ukraine, “[o]n 14 September 2016, the Ministry of Foreign Affairs of Ukraine officially served the Ministry of Foreign Affairs of the Russian Federation with a notification of arbitration and statement of claim instituting ad hoc arbitral proceedings under Annex VII of UNCLOS”.

A maritime delimitation agreement has been reached between Colombia, Costa Rica and Ecuador. This agreement has been formally reached at the Galapagos islands of Ecuador. IMO: BWM Convention enters into force on 8 September 2017
The Ballast Water Management Convention was ratified by a sufficient number of states on 8 September 2016, bringing the total gross tonnage to over 35% from the signatory states. This means the convention will enter into force 12 months later, on 8 September 2017. Accession by Finland has triggered the entry into force of this key international measure for environmental protection that aims to stop the spread of potentially invasive aquatic species in ships’ ballast water. CLCS: Uruguay to extend continental shelf up to 350 nautical miles
The Commission on the Limits of the Continental Shelf has communicated its recommendation for the establishment of the outer limits of the Uruguayan continental shelf. According to a statement by the Ministry of Foreign Affairs of Uruguay, this recommendation implies “a territorial extension for Uruguay of approximately 83.000 sq km, encompassing all its continental margin and allowing to establish what has been called the country’s final frontier at 350 nautical miles”. PCA: The Duzgit Integrity Arbitration (Malta v. São Tomé and Príncipe) Award delivered
The Tribunal constituted under Annex VII to the United Nations Convention on the Law of the Sea (UNCLOS) in the matter of the Duzgit Integrity Arbitration has just issued an Award in respect of the dispute between the Republic of Malta and the Republic of São Tomé and Príncipe. The dispute concerns the arrest by São Tomé of a Maltese flagged vessel – the Duzgit Integrity – on 15 March 2013 when it attempted to undertake a ship-to-ship (“STS”) cargo transfer in São Tomé’s archipelagic waters, and the subsequent measures taken by São Tomé in relation to the vessel, its master, cargo, owner and charterer.
The Tribunal found that it had jurisdiction over the dispute and that, while the initial detention of the vessel fell within the lawful exercise by São Tomé of its law enforcement jurisdiction, the other penalties imposed by São Tomé could not be regarded as proportional to the original offence or the interest of ensuring respect for São Tomé’s sovereignty. Accordingly, the Tribunal held that the cumulative effect of the sanctions imposed by São Tomé was incompatible with Article 49 of the UNCLOS and that Malta was entitled to claim reparation in a further phase of the proceedings.

49th ASEAN Foreign Ministers’ Meeting Communique and Joint Statement SCS
Reference to the PCA, South China Sea Arbitration Award of 12 July 2016, was dropped from the communique issued by the first meeting of Association of Southeast Asian Nations (ASEAN) foreign ministers since the issue of the Award, following objection by Cambodia. The communique and joint-statement emphasize the peaceful settlement of disputes, and reaffirm the Declaration on the Conduct of Parties in the South China Sea.

Conference: Obligations of States in Undelimited Maritime Areas
The British Institute of International and Comparative Law is holding in London, the UK, an event entitled “Obligations of States in Undelimited Maritime Areas”. This event will analyse and discuss the obligations of States in regard to undelimited areas pending agreement on maritime boundary delimitation. In particular, the event will focus on the obligations of States under Articles 74(3) and 83(3) of UNCLOS to refrain from activities that could jeopardise or hamper the reaching of a final agreement on maritime delimitation. PCA: Philippines v. China (final Award)
The PCA has issued today a unanimous Award in the arbitration instituted by the Republic of the Philippines against the People’s Republic of China. This arbitration concerned the role of historic rights and the source of maritime entitlements in the South China Sea, the status of certain maritime features and the maritime entitlements they are capable of generating, and the lawfulness of certain actions by China that were alleged by the Philippines to violate the UNCLOS. IMO: SOLAS regulation on enclosed spaces enters into force
A new regulation aimed at protecting seafarers who need to enter enclosed spaces, by requiring ships to carry portable atmosphere testing equipment on board, entered into force on 1 July 2016. The new regulation XI-1/7 Atmosphere testing instrument for enclosed spaces in the International Convention for the Safety of Life at Sea (SOLAS), requires ships to carry an appropriate portable atmosphere testing instrument or instruments, capable, as a minimum, of measuring concentrations of oxygen, flammable gases or vapours, hydrogen sulphide and carbon monoxide, prior to entry into enclosed spaces. The Piraeus Bar Association is organizing the 9th edition of its International Conference of Maritime Law. This event is the sequel of a tradition established 24 years ago. PCA: Philippines v. China (date for issuance of final Award)
The Permanent Court of Arbitration has today informed the Parties that the Tribunal will issue its Award in the arbitration initiated by the Republic of the Philippines against the People’s Republic of China under Annex VII to the United Nations Convention on the Law of the Sea. UNCLOS: Azerbaijan accession
The 16 June 2016 marked the accession of Azerbaijan to the United Nations Convention on the Law of the Sea (UNCLOS). In accordance with UNCLOS, Article 308(2), the Convention shall enter into force for Azerbaijan on 16 July 2016.
