World Oceans Day is celebrated today, the 8th June. This year’s theme is “Healthy Oceans, Healthy Planet”, with a focus upon plastic pollution. Various events around the World continue today, and into the forthcoming weekend, under the coordination of The Ocean Project.

PSMA: Entry into Force 5 June 2016

The 2009 FAO Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing (PSMA), has reached the required threshold of formal deposits of adherence and will therefore enter into force on 5 June 2016. According to the FAO press release, the following states and regional economic integration organization are parties to the PSMA: Australia, Barbados, Chile, Costa Rica, Cuba, Dominica, European Union – Member Organization, Gabon, Guinea Bissau, Guyana, Iceland, Mauritius, Mozambique, Myanmar, New Zealand, Norway, Oman, Palau, Republic of Korea, Saint Kitts and Nevis, Seychelles, Somalia, South Africa, Sri Lanka, Sudan, Thailand, Tonga, United States of America, Uruguay, and Vanuatu.

Unconfirmed reports also suggest Gambia has ratified the PSMA within its internal National Assembly, however, according to the FAO website, it has not yet formally deposited an instrument of adherence.

IMO: MSC agrees on new bulk carrier rules

IMO’s Maritime Safety Committee (MSC) has confirmed that ship construction rules for oil tankers and bulk carriers submitted by 12 classification societies conform to the goals and functional requirements set by the Organization for new oil tankers and bulk carriers. This marks a significant new development in how international standards for ship construction are determined and implemented. For the first time, IMO has been given a role in auditing and verifying the structural rules developed by the classification societies for new-build oil tankers and bulk carriers. PCA: the “Enrica Lexie” Incident (Italy v. India) Arbitral Tribunal Order issued

On 29 April 2016, the Arbitral Tribunal in the arbitration concerning the “Enrica Lexie” incident (Italy v. India) adopted its Order in respect of a request by Italy for the prescription of provisional measures. In the operative part of the Order, the Arbitral Tribunal unanimously prescribed the following provisional measures:

a) Italy and India shall cooperate, including in proceedings before the Supreme Court of India, to achieve a relaxation of the bail conditions of Sergeant Girone so as to give effect to the concept of considerations of humanity, so that Sergeant Girone, while remaining under the authority of the Supreme Court of India, may return to Italy during the present Annex VII arbitration.
b) The Arbitral Tribunal confirms Italy’s obligation to return Sergeant Girone to India in case the Arbitral Tribunal finds that India has jurisdiction over him in respect of the “Enrica Lexie” incident.
c) The Arbitral Tribunal decides that Italy and India each shall report to the Arbitral Tribunal on compliance with these provisional measures, and authorizes the President to seek information from the Parties if no such report is submitted within three months from the date of this Order and thereafter as he may consider appropriate.

UNCLOS: Timor-Leste and Australia Maritime Boundary Dispute

Timor-Leste initiated compulsory conciliation with Australia on the 14th April 2016, under the provisions of UNCLOS, in order “to facilitate the conclusion of an agreement with Australia on permanent maritime boundaries”. On the 2nd May 2016 the government of Australia has informed Timor-Leste of its two appointments to the Conciliation Commission. They shall now work with the two Timor-Leste appointed conciliators in order to appoint a fifth member, before the Commission begins its work.

Marshall Islands: maritime boundaries declared to UN

The Republic of the Marshall Islands has reached a major milestone in ocean resource management and international relations following the submission of their completed maritime boundary legislation to the United Nations on 22 April 2016. This legislation includes more than 450 pages of geographical coordinates, treaty agreements, and a total of 25 charts which will officially declare the baselines and the outer limits of all of its maritime zones under the national jurisdiction of the Marshall Islands. 6th conference in Maritime Spatial Planning Worldwide

The sixth conference of the MSP stakeholder series, focussing on MSP Worldwide will be organised on 8 and 9 June 2016 by DG MARE in University of the Azores, Ponte Delgada, Azores. The conference will present experiences, opportunities and challenges of MSP implementation around the world. In particular it will look at MSP’s economic benefits, its potential as a climate adaptation tool as well as at the role of area-based management regimes in international waters. IMO: mandatory requirements on fuel consumption data approved

The Marine Environment Protection Committee (MEPC) of the International Maritime Organization (IMO) has approved mandatory requirements for ships to record and report their fuel consumption.The draft mandatory data collection requirements will be put forward for adoption at the 70th MEPC session in October this year and could enter into force in 2018. The data collection system is enshrined in draft amendments to the International Convention for the Prevention of Pollution from Ships (MARPOL), which were approved by the 69th session of the MEPC, meeting at IMO Headquarters in London this week (18 to 22 April). More information on the matter available here.

ICJ: Nicaragua v. Colombia judgment on preliminary objections delivered

The International Court of Justice delivered its Judgment on the preliminary objections raised by Colombia in the case concerning Question of the Delimitation of the Continental Shelf between Nicaragua and Colombia beyond 200 nautical miles from the Nicaraguan Coast (Nicaragua v. Colombia). The Court found that it has jurisdiction, on the basis of Article XXXI of the Pact of Bogotá, to entertain the First Request put forward by Nicaragua in its Application, in which it requests the Court to determine “the precise course of the maritime boundary between Nicaragua and Colombia in the areas of the continental shelf which appertain to each of them beyond the boundaries determined by the Court in its Judgment of 19 November 2012”, and that that Request is admissible. Barbados and South Africa Accede to the Port State Measures Agreement

During the month of February, Barbados (2 February 2016) and South Africa (16 February 2016) acceded to the FAO Port State Measures Agreement (PSMA). The PSMA will enter into force 30 days after the 25th ratification, acceptance, approval or accession.

UNSC: Resolution 2270 Non-proliferation/Democratic People’s Republic of Korea

On the 2 March 2016 the UN Security Council adopted Resolution 2270,  Non-proliferation/Democratic People’s Republic of Korea. This contains a number of port state and flag state obligations, of particular note see paragraphs 18, 22, and, 19, 20, 29-31, respectively. Media reports suggest China has already barred a North Korean vessel’s entry to the port of Rizhao.

Conference: International Law and Japanese Approaches – The Law of the Sea and International Peace Operations

On 26 February 2016, the T.M.C. Asser Instituut will organise a Symposium on International Law and Japanese Approaches. Rhodes Academy 2016

Our Ocean 2015: Initiatives

The second Our Ocean conference was held in Valparaiso, Chile from 5-6 October. Participants announced over 80 new initiatives, covering the protection of ocean areas, promoting sustainable fisheries, reducing marine pollution, preventing and monitoring ocean acidification, building capacity, supporting coastal communities, and mapping and understanding our ocean.

Taiwan, Philippines sign fisheries law enforcement agreement

After several rounds of negotiations in the past two years, Taiwan and the Philippines concluded the Agreement Concerning the Facilitation of Cooperation on Law Enforcement in Fisheries Matters on November 5, 2015. The agreement contains seven articles and includes three important points of consensus that have already been implemented—avoiding the use of violence or unnecessary force, establishment of an emergency notification system, and establishment of a prompt release mechanism. PCA: the “Enrica Lexie” Incident (Italy v. India)

Months after the ITLOS Order on the “Enrica Lexie” Incident has been delivered (see post), the Permanent Court of Arbitration just announced that the constitution of the Arbitral Tribunal in an arbitration between the Italian Republic and the Republic of India under Annex VII to the UNCLOS has been completed. PCA: Philippines v. China (Award on Jurisdiction and Admissibility)

The Permanent Court of Arbitration has rendered an Award on Jurisdiction and Admissibility in case number 2013-19; The Republic of Philippines v. The People’s Republic of China. In short, by unanimous decision the Tribunal has decided the Tribunal has jurisdiction to consider the Philippines’ Submissions No. 3, 4, 6, 7, 10, 11, and 13 (subject to conditions discussed in in paragraphs 400, 401, 403, 404, 407, 408, 410); reserved consideration of its jurisdiction to rule on Submissions No. 1, 2, 5, 8, 9, 12, and 14 to the merits phase; and directed the Philippines to clarify the content and narrow the scope of its Submission 15 (reserving consideration of its jurisdiction to the merits phase).

Palau: National Marine Sanctuary Act signed

The western Pacific archipelago of Palau has approved the creation of a marine sanctuary. The sanctuary becomes the world’s sixth-largest fully protected area. This means that 80% of the nation’s maritime territory is now designated as a reserve. The bill to create it was passed unanimously, 16-0 in the house of delegates, and the senate voted to adopt it. Japan: Modified declaration accepting the ICJ’s compulsory jurisdiction

On the 6th October 2015, Japan submitted a revised Declarations Recognizing as Compulsory the Jurisdiction of the International Court of Justice Under Article 36, Paragraph 2, of the Statute of the Court. Note the acceptance of compulsory jurisdiction does not apply to:

“(3) any dispute arising out of, concerning, or relating to research on, or conservation, management or exploitation of, living resources of the sea”

IMO: Revised guidance on radioactive waste adopted

Updated guidelines for the application of the de minimis (exempt) concept for radioactive substances which may be considered for dumping at sea have been adopted. The 2015 Guidelines for the application of the de minimis concept include recognition of effects of radiation on marine fauna and flora. They were adopted by the 37th Consultative Meeting of Contracting Parties (London Convention 1972) and 10th Meeting of Contracting Parties (London Protocol 1996), which were meeting for their regular joint meeting at IMO in London. UNSC: Resolution 2240 (2015)

The United Nations Security Council adopted on 9 October a resolution authorizing states to exercise exceptional powers with respect to ships suspected of being engaged in human trafficking and migrant smuggling on the high seas off the costs of Libya. The resolution can be found here.

The Centre for International Law (CIL) at the National University of Singapore (NUS) and the K.G.
